These Terms apply to all sales. These Terms override and are in substitution for any terms stipulated or referred to in writing or orally by the buyer

Sendz reserves the right to modify and vary these Terms at any time.

1. PRICE

1.1 Sendz may alter prices of the products without prior notice.

1.2 All prices list on Sendz are in Australia Dollar and include Goods and Services Tax and any other government duties

in respect of the Products.

2. PAYMENT

2.1 Unless Sendz has agreed to extend credit to the buyer, payment is to be made in cash with order.

2.2 Sendz accepts Visa and MasterCard online payment, Bank transfer and deposit.

2.3 Payment by cheque or by any type of bank deposit will not be considered payment until the payment has been fully cleared.

3. RISK AND DELIVERY

3.1 Sendz use CourierPost overnight country wide service to deliver within Australia. However, according to CourierPost, Rural Delivery could take 2-3 days to reach. Mostly, courier service delivery arrives the next day of dispatch except weekend and public holiday.

3.2 Sendz charges shipping fee based on Australia post and some other Australia courier.

3.3 All claims for shortage or damage during delivery must be made to both the carrier and Sendz immediately and at the latest within 48 hours of the date of delivery.

3.4 Sendz will make every effort to ensure delivery of Products, or performance of services, is on time but will not be liable to the buyer for any loss or damage arising in any way from any delay in delivery or performance.

4. RETENTION OF TITLE

4.1 Notwithstanding any period of credit, ownership of Products remains with Sendz and will not pass to the buyer until those Products supplied to the buyer have been paid for in full.

4.2 the buyer must not represent to any third party that the buyer are in any way acting for Sendz , and Sendz is not bound by any contract between the buyer and any third party.

5. CLAIMS AND LIABILITY

5.1 Sendz guarantees its products to be free from manufacturer defects. Liability under this warranty is limited to the replacing of any product found to be defective under normal use. For the avoidance of doubt, Sendz shall have no obligation to provide refunds.

5.2 Sendz will not be liable in any event for any loss or damages of any kind, whether direct, or special, or indirect or consequential, howsoever arising, whether or not Sendz had knowledge that such damages might be incurred, including but not limited to loss of income, profit, interest, opportunity, utility or loss of market, incurred by the buyer or by any third party.

5.3 Nothing in these Terms shall exclude or restrict any rights or remedies the buyer may have under the Fair Trading Act 1986.

6. INTELLECTUAL PROPERTY

6.1 The buyer shall not use any trade marks which are the property of Sendz or its Suppliers, or any similar words or marks, or any combination of words which includes any of those trade marks or any similar words or marks.

7. LAW

These Terms are governed by the laws of Australia and any dispute under them shall be subject to the jurisdiction of the Courts of Australia.

8. PRIVACY POLICY

As protecting consumer privacy is very important to us, we are committed to ensuring the privacy of our visitors and customers. We make a policy devoted to strict customer confidentiality at all times. If there is any change to this policy statement, it will be updated on our website immediately.

Collection of Information

Sendz collects information directly from customers through online application forms, fax, post, e-mail and phone. We may ask for some of your details such as name, telephone number, fax number, post and e-mail address in order to complete your order. Any information that collected by Sendz is collected and processed in accordance with Australia's Privacy Act 1993.

You may correct and change your personal information held by us by logging on your account any time. Simply click My account on the site and entering your User Name and Password.
